The trademarks, logos, tradenames and servicemarks ("Marks") displayed on the Site are the property of LeadsGiant.com and its associates and other parties. Users are prohibited from using any Marks for any purpose including, but not limited to use as metatags on other pages or sites on the World Wide Web without the written permission of LeadsGiant.com and its associates or such third party which may own the Mark. All information and content, including without limitation, any software programs, available on or through the Site ("Content") is protected by copyright. Users are prohibited from modifying, copying, distributing, transmitting, displaying, publishing, selling, licensing, creating derivative works or using any Content available on or through the Site for any purpose without express written consent from LeadsGiant.com and its associates. By placing your order with LeadsGiant.com and its associates, you agree to be referred to as client. As agreed, Client agrees not to resell any lead or genealogy list provided by LeadsGiant.com and its associates for any period of time unless expressly permitted through written correspondence between Client and LeadsGiant.com and its associates. Client understands that all opt-in leads have opted into a generic advertisement to request certain information on how to earn an income through a home-based business or business opportunity. Client understands all orders are handled in the order they are received. LeadsGiant.com and its associates cannot rush any particular order above another. There may be problems with your order, if a problem or delay occurs with your order; LeadsGiant.com and its associates will contact Client as soon as possible to inform Client of the estimated time that the problem will be corrected. Client agrees that LeadsGiant.com and its associates will not assume or accept any liability or responsibility for a client's marketing practices to any opt-in lead or Genealogy List sold to Client. Client agrees that it is LeadsGiant sole responsibility to comply with all State and Federal Laws when marketing to any lead or list provided by LeadsGiant.com and its associates . Client agrees that Genealogy lists are not opt-in leads and are sold as is. LeadsGiant.com and its associates do not guarantee or warrant any of our genealogy lists to be accurate in any sense, nor do we guarantee or warrant marketable performance of any genealogy list sold. Also, refunds (monetary, etc.) are not offered for any reason as Genealogy lists are sold as is. Client agrees that due to the nature of products and services rendered by LeadsGiant.com and its associates, refunds (monetary, etc.) cannot be given after an order has been processed as once an opt-in lead is sold once it can only be sold again one more time. Client agrees that LeadsGiant.com and its associates are not responsible for circumstances or problems that happen with your autoresponder, bulk mail, or email service provider. If your autoresponder, ISP, etc. is blacklisted for SPAM or your messages are not getting through due to server outages, etc. we will not be held liable. Client agrees these types of problems are not affiliated with any purchased leads and as such, no lead will be replaced for these types of instances. Client understands it is LeadsGiant sole responsibility to comply with any autoresponder's (or mail system you use) policies and procedures as well as terms and conditions. Client agrees that LeadsGiant.com and its associates do not guarantee or warrant the marketable performance (response rate, click through rate, etc.) of any lead or Genealogy list sold. Client agrees to forward any SPAM complaint to LeadsGiant.com and its associates by email at info@LeadsGiant.com. Upon receipt of the SPAM complaint client agrees that LeadsGiant.com and its associates will provide the additional opt-in information (opt-in URL and lead capture page) within 48-72 hours to prove opt-in status of the person filing the SPAM complaint if that email address originated from a lead purchased by client from LeadsGiant.com and its associates. Client understands that Genealogy lists sold by LeadsGiant.com and its associates are not opt-in leads and as such are not protected under the aforementioned SPAM Complaint clause.   Client agrees LeadsGiant.com and its associates are in no way responsible for incorrect email addresses, bad phone#'s, etc... if you receive a bad phone# for a Phone Interviewed lead that lead will be replaced 1 for 1. Unfortunately, it is impossible to "police" the quality of the information a lead is entering as with any type of internet advertising. We do our best through our filtering process to eliminate invalid leads. However, we do add a minimum of 10% extra leads to every order to compensate client in advance for any invalid lead that manages to pass through our screening process. Client agrees LeadsGiant.com and its associates will not replace any lead for client that is not deliverable due to: Full Inbox, Out of office reply, Network Temporarily unavailable, etc also known as a "Soft Bounce".. Client Agrees to give LeadsGiant.com and its associates, leniency in fulfilling orders in cases of server outages, connection issues, delays on ad servers, or other circumstances beyond our control. Client will be contacted within 24 hours of any such circumstance affecting client's order. If the circumstance will be foreseen as taking 72 hours to fix a refund of client's order may be granted if requested by client after notice of problem taking 72 hours is received by client.. Client agrees to allow up to 24 Hours for email response to your questions! If you have any questions or problems with your order, please do not hesitate to contact us at anytime.
